Effective December 1, 2014, the Court Of Queen’s Bench will have a new practice note in Calgary only. The new practice note, entitled “Intake, Resolution and Caseflow Management”, will implement a new early resolution and caseflow service to better meet the needs of family litigants.
Through this new program, there are some important requirements to be aware of. For example:
- Applicants who are not represented by legal counsel will be required to consult with an intake counsel about options and possible referrals before filing their application. (Note – Respondents who wish to respond to applications may also consult with an intake counsel about options and possible referrals.)
- Legal counsel for those applicants who are represented will also be required to inform the applicant of the option to schedule a caseflow conference before filing their client’s application.
Please note that the program under the practice note is limited to parenting and child support applications under the Family Law Act and under the Extra-provincial Enforcement of Custody Orders Act. You can find the new practice note (#9) and its detailed provisions here: Court of Queen’s Bench of Alberta Family Law Practice Note 9
Court of Queen’s Bench Family Law Practice Note 4 has also been amended to reflect the implementation of this new program, by the addition of a new paragraph 1. You can find the revisions to practice note 4 here: Court of Queen’s Bench of Alberta Family Law Practice Note 4
